Actos Lawsuit
In December 2011, hearings took place to decide whether or not Actos lawsuits will be consolidated in Multidistrict Litigation (MDL). It is because the amount of lawsuits that have been filed by victims of Actos that the Judicial Panel on Multidistrict Litigation (JPML) is considering consolidating these claims. An MDL is not like a mass tort in that an MDL still allows all of the individual claimants to retain their individual status; in other words, they are not grouped into a class.
Currently, it is assumed by most insiders and observers that an Actos MDL will take place; however, a crucial question is where just an MDL will be centered. Some locations are more favorable for the defendant and some are more favorable for the plaintiffs.So far, as many as 1,000 Actos bladder cancer lawsuits are assumed to be consolidated if the MDL does indeed take place.
